Having returned from a truly inspiring and constructive GGI Leadership Forum in Eisenberg a few weeks ago, I am delighted to present to you the latest issue of our Practice Group FYI News, just in time before our next Practice Group meeting at the the upcoming GGI World Conference in Tokyo, Japan.
I am very grateful that so many members have once again sent their articles, making this issue of our newsletter certainly one of the more voluminous issues. I am sure that the articles – all written by renowned experts in their respective fields – will be of interest to you.
This time 12 authors sent their articles. A truly impressive response from our members. I highly recommend them all to you.
Our lead article from Nico van der Peet (Thuis Partners Advocaten, The Netherlands) is about “A shift in company risks and the European NIS 2 Directive” and includes a poll for readers to get involved.
The first group of articles covers procedural issues:
Mujir Muneeruddin (Pallett Valo LLP, Canada) deals with “Balancing act: Corporate neutrality in shareholder disputes explored in Yen v Ghahramani”. Leslie Berkoff (Moritt Hock & Hamroff LLP, USA) looks at how the “US Supreme Court decides underlying lawsuit must be stayed once claims are compelled to arbitration”. Francesca Parker (Kingsley Napley LLP, UK) writes about “International arbitration: Bringing non parties to the party”. James P. Martin and his colleague Ryan Goodfellow (Cendrowski Corporate Advisors, USA) inform us on “AI systems and fraud investigations”.
The second group of articles deals with issues of substantive law:
Piotr Bobrowski (Penteris, Poland) explores “The legal landscape of digital wills and AI: Challenges and opportunities.” João Frias Costa, (GPA Law Firm, Portugal) informs us about "Scania is next – a new opportunity to seek compensation with recent Truck Cartel ruling by the EU Court of Justice”. Johannes R. Jeep (FPS, Germany) provides an overview on the “Act on the Modernisation of Partnership Law (MoPeG) – the most important changes for practice.“ Maria Lucrecia Cucchiaro and Silvia Giannini (Kairós Legal & Business Consultants, Italy) present “A fast track for return trip to Italy: Judicial recognition of Italian citizenship”. Elena Tarli (BussolettiNuzzo Avvocati, Italy) summarises a decision of “The Bologna Court on the independence of a shareholders’ meeting chair”. Jason B. Hirsh (Levenfeld Pearlstein, LLC, USA) explains “How to mitigate post-closing risks to facilitate asset distribution and entity dissolution” and, finally, Freddy Karyadi (Protemus Capital, Indonesia) covers the topic of “Indonesia: M&A through debt restructuring mechanisms”.
As you can see, our Practice Group FYI News is a wonderful opportunity for GGI members to showcase their expertise and become more visible to other members. I invite you all to take advantage of this great opportunity -- our next FYI news will be published in February 2025.
