I hope you all had a great summer or a great winter, as the case may be. The GGI World Conference 2025 in Zurich (30 October to 02 November 2025) is rapidly approaching. It is a special conference, as this year we celebrate 30 years of GGI!
I am grateful that once again we can share with you an issue of our Litigation & Dispute Resolution Practice Group's FYI News, full of interesting articles. With the generous support of our members as authors, we are able to present a truly impressive number of eleven articles to mark the 30th anniversary of our GGI family.
These contributions reflect the latest legal developments in the authors’ respective national jurisdictions. Concise and to the point, these pieces were written by practitioners for practitioners, and I warmly recommend all of them to you.
The leading article by Jordi Pallarès Vinyoles (VILAR RIBA, Spain) discusses the validity of electronic signatures in international transaction documents. Additional articles featured in this issue can be grouped into topics of procedural law and of substantive law.
On matters of procedural law, there is an update from Michiel Teekens (TeekensKarstens advocaten notarissen, The Netherlands) on the recent Netherlands commercial court ruling on jurisdiction in cross-border loan disputes; Nicole Plattner (Ruiz Ballesteros Lawyers and Tax Advisors, Spain) talks about major reforms in Spain fast-tracking criminal proceedings against squatters; and Leslie A. Berkoff (Moritt Hock & Hamroff LLP, USA) writes about a recent Illinois bankruptcy court decision which allows some claims to proceed to arbitration.
Safi Riba and Gilli Cohen Arazi (Soroker Agmon Nordman Riba, Israel) provide an update on mandatory alternative dispute resolution (ADR) in Israeli family litigation. Samanta Crivelli (Bratschi AG, Switzerland) talks about how 2025 reforms have strengthened the mandatory conciliation model in Switzerland; and Tony Nunes and Matthew Broadhurst (Kelly+Partners Chartered Accountants, Australia) discuss whether the mutual agreement procedure overrides domestic disputes.
In the field of substantive law, Nico van der Peet (Thuis Partners, The Netherlands) shares legal pitfalls and some solutions for international family businesses; Richard Clayman (Kingsley Napley, UK) talks about boards of directors and objective standards of honesty in corporate decision making; Carlyn Weale (Ward Hadaway LLP, UK) addresses the challenges of business protection, third-party claims and recoveries in cyber litigation; and Michał Wiewióra (Penteris, Poland) shares the risks of AI use in the legal profession.
